Terms and Conditions
Please read these terms carefully before using the ExciteWave website or reserving a Reso 2.
These Terms and Conditions ("Terms") govern your access to and use of the ExciteWave Innovations website, including any reservation, purchase, or account created through it (together, the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who We Are
ExciteWave Innovations ("ExciteWave," "we," "us," or "our") is based in Los Angeles, California. These Terms apply to all visitors, users, and reservation holders.
2. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to misuse the Site, interfere with its normal operation, attempt to gain unauthorized access to any part of it, or use it to transmit any harmful or unlawful content.
3. Product Reservations and Payments
Reserving a Reso 2 requires a $1 deposit, which is fully refundable at any time prior to shipment unless otherwise stated at checkout. A reservation is not a guarantee of a specific ship date, final price, or final product specification. Estimated shipping windows are provided for planning purposes only and may change. The remaining balance is due when your Reso 2 ships, at the price in effect at that time unless we have agreed otherwise in writing.
All payments are processed by a third-party payment processor. We do not store your full payment card details on our own servers.
4. Intellectual Property
The Site, including its text, graphics, logos, product designs, and software, is owned by ExciteWave Innovations or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission, except as permitted for personal, non-commercial use.
5. Disclaimers
The Site and any information on it are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free.
6. Limitation of Liability
To the fullest extent permitted by law, ExciteWave Innovations will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any product reservation, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms will not exceed the amount you paid to us in the twelve months preceding the claim.
7. Third-Party Links and Services
The Site may contain links to third-party websites or services, including payment processors and social media platforms, that are not owned or controlled by ExciteWave Innovations. We are not responsible for the content, policies, or practices of any third-party sites or services.
8. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Your continued use of the Site after any changes take effect constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles, unless otherwise required by applicable law.
10. Third-Party Trademarks
Case brand names referenced on this Site, including Pelican, DeWalt, Milwaukee, and Samsonite, are trademarks of their respective owners. They are used solely to describe the types of cases our products are designed to fit inside. Unless a page explicitly states otherwise, ExciteWave Innovations is not affiliated with, sponsored by, or endorsed by these companies, and reference to a brand name does not imply any partnership, license, or business relationship with it.
